These Terms and Conditions ("Terms") govern your access to and use of the ATELIER ZEN-Ō website and the purchase of products and services. By accessing our Platform or placing a commission, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.
These Terms should be read together with our Privacy Policy and any other notices or policies referenced herein. All documents together constitute the complete agreement between you and ATELIER ZEN-Ō.
You must be at least 18 years of age to place a commission or make a purchase. By submitting a commission inquiry or completing a purchase, you represent and warrant that you are of legal age and have the legal capacity to enter into a binding contract.
All information you provide in connection with a commission or account must be accurate, current, and complete. ATELIER ZEN-Ō reserves the right to refuse service, cancel commissions, or terminate accounts at our sole discretion.
All ATELIER ZEN-Ō products are made to commission. The commission process operates as follows:
Each commission is a unique, hand-crafted creation. Minor variations in colour, grain, and texture are inherent to natural leather and are not defects. They are evidence of authenticity.
All prices are listed in United States Dollars (USD) unless otherwise stated. Prices shown are starting prices; the final price for your commission is confirmed in your written commission acceptance. Prices are subject to change without notice, except that changes will not affect accepted commissions for which a deposit has been received.
Completed commissions are shipped via fully insured, signature-required carriers to the delivery address specified at time of commission. Shipping costs are communicated at commission confirmation and are the responsibility of the client.
Risk of loss passes to the client upon delivery to the carrier. If your commission is lost or damaged in transit, please notify us immediately at atelier@zeno-s.com and we will assist with the insurance claim process.
International shipments may be subject to customs clearance delays and import duties. ATELIER ZEN-Ō is not responsible for delays or costs arising from customs procedures in the destination country.
Because each ATELIER ZEN-Ō commission is made to order for a specific client using materials selected at the time of commission, all sales are final. Commissions may not be returned or exchanged, except in the case of a manufacturing defect as described below.

To the fullest extent permitted by applicable law, ATELIER ZEN-Ō shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our Platform or products, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from your commission or use of our Platform shall not exceed the amount paid by you for the specific commission giving rise to the claim.
Nothing in these Terms shall limit liability that cannot be excluded by law, including liability for fraud, death, or personal injury caused by negligence.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your commission shall first be subject to good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be submitted to binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.
ATELIER ZEN-Ō reserves the right to modify these Terms at any time. Updated Terms will be posted on our Platform with a revised "Last Updated" date. Your continued use of the Platform following any update constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.
For accepted commissions in progress at the time of any material change, the Terms in effect at the time of commission confirmation shall continue to apply unless you agree to the updated Terms.
